A worker injured in last week’s ammonia release at a chemical plant in Matagorda County has filed a lawsuit against the company, alleging negligence.
The lawsuit was filed on behalf of Luis Arturo Solano Aguilar by attorneys from Abraham, Watkins, Nichols, Agosto, Aziz & Stogner, along with the Law Offices of Hilda L. Sibrian. Aguilar was reportedly working as a contractor at the Roehm USA facility near Bay City on March 7 when the ammonia release occurred.
According to the law firm, Aguilar was exposed to toxic fumes and suffered severe injuries while trying to escape the incident.
Allegations Against the Company
The lawsuit names OQ Chemicals Corporation, the alleged owner of the refinery, as a defendant. It claims that the company failed in several areas, including:
- Properly inspecting and monitoring the facility
- Supervising refinery operations
- Implementing adequate safety policies and procedures
- Correcting hazardous conditions
- Warning workers about potential dangers
- Violating industry regulations and standards
The lawsuit accuses OQ Chemicals of gross negligence and seeks punitive damages. Aguilar is also requesting compensation for physical and mental suffering, medical expenses, lost wages, and other damages.
Incident Overview
Authorities reported that a total of 10 workers were hospitalized due to the ammonia release, which was caused by a PSV valve failure in a brine cooler. The investigation into the incident is ongoing.
